ORDINANCE NO. 705-18

AN ORDINANCE TO AMEND THE TRENTON CITY ZONING CODE, SECTION 110-313 (1) (a) AND (b) BY DELINEATING THE STREETS WHERE FIRST FLOOR OCCUPANCY IS PERMITTED IN (a) AND SETTING FORTH THE REQUIREMENTS IN (b), BY ADDING NEW SUB-SECTIONS (b) (1), (2) AND (3); AND REFERENCING SECTION 110-511 in (f).

THE CITY OF TRENTON ORDAINS:

Section 1. Section 110-313 Principal uses permitted subject to special conditions shall be amended in 1 (a) (b) and (f) to read as follows:

a. No dwelling unit shall occupy any portion of the floor area of the building at grade level along West Jefferson or West Rd.

b. Dwelling units on the first floor at grade level may be permitted if all of the following conditions are met:

1. The dwelling unit is setback no less than thirty-five (35) feet from West Jefferson or West Road, respectively.

2. The façade of the dwelling unit along any street contains at least thirty-five (35) percent glass windows and doors. The Planning Commission may grant a reduction allowing twenty-five (25) percent glass windows and doors if the applicant provides additional architectural features acceptable to the Planning Commission.

3. The building material of the façade of the dwelling unit along the street is brick.

c. Business uses may occupy any number of the total floor in the building, but no business shall be located on the same floor as a residential use.

d. No floor in the building may be used for business purposes that is located above a floor used for residential purposes.

e. No dwelling unit shall have more than two bedrooms.

f. Each dwelling unit shall comply with the minimum applicable floor area requirement set forth in Section 110-511, Schedule of regulations, in this chapter.

g. Off-street parking shall be provided for each dwelling unit in accordance with the applicable requirements of Article XXVI in this chapter unless otherwise excused.

Section 2. Savings Clause. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

Section 3. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such work, sentence, phrase or any portion of the Ordinance held to be so invalid shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance.

Section 4. Conflicting Ordinances. All prior existing ordinances adopted by the City of Trenton inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed.

Section 5. Readings. This Ordinance shall be given a first reading on August 7, 2017, shall be enacted on August 21, 2017, and shall be published on or before August 28, 2017, and shall be effective August 29, 2017.
