ORDINANCE NO. 789

AN ORDINANCE OF THE CITY OF TRENTON ADOPTING THE 2015 EDITION OF THE INTERNATIONAL FIRE CODE, REGULATING AND GOVERNING THE SAFEGUARDING OF LIFE AND PROPERTY FROM FIRE AND EXPLOSION HAZARDS ARISING FROM THE STORAGE, HANDLING AND USE OF HAZARDOUS SUBSTANCES, MATERIALS AND DEVICES, AND FROM CONDITIONS HAZARDOUS TO LIFE OR PROPERTY IN THE OCCUPANCY OF BUILDINGS AND PREMISES IN THE CITY OF TRENTON; AND PROVIDING FOR THE ISSUANCE OF PERMITS FOR HAZARDOUS USES OR OPERATIONS.

THE CITY OF TRENTON, WAYNE COUNTY, MICHIGAN, DOES ORDAIN AS FOLLOWS:

Section 1. Section 42-181 of Article III entitled "Fire Prevention Code" is hereby amended as follows and shall read in its stead:

Section 42-181 International Fire Code adopted.

A certain document, one (1) copy of which is on file in the office of the City Clerk of Trenton, Michigan, being marked and designated as the 2015 International Fire Code, including Appendix B (Fire-Flow Requirements for Buildings), C (Fire Hydrant Locations and Distribution), D (Fire Apparatus Access Roads), F (Hazard Ranking), G (Cryogenic Fluids), H Hazardous Materials Management Plan and Hazardous Materials Inventory Statement Instructions), I (Fire Protection System Non-Compliant Conditions), as published by the International Code Council, be and is hereby adopted as the fire code of the City of Trenton for regulating and governing the safeguarding of the life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of such International Fire Code on file in the office of the City Clerk of City of Trenton, Michigan, are hereby referred to, adopted and made a part hereof as if fully set out in this article with the additions, insertions, deletions and changes, if any, prescribed in section 42-183 of this article.

Section 2. Section 42-182 of Article III entitled "Enforcement" is hereby amended as follows and shall read in its stead:

Section 42- 182 Enforcement

The fire prevention code adopted by this article shall be enforced by the Chief of the Fire Department, the Fire Department Fire Inspector, and/or the Fire Chief's designee.

Section 3. Section 42-183 of Article III entitled "Amendments." is hereby amended as follows and shall read in its stead:

Whenever the following words or phrases are used in the Fire Prevention Code adopted by this Article, they shall have the same meanings respectively ascribed to them by this section:

Chief of the bureau of fire prevention and bureau of fire prevention mean the Chief of the Fire Department and the Fire Inspector.

Corporation Counsel means the City Attorney

Municipality means City of Trenton, Michigan.

The following sections are hereby revised:

Section 101.1 [Name of Jurisdiction] to City of Trenton, Michigan.

Section 109.4 [Specify Offense] to Misdemeanor, [Amount] to $500.00. [Number of Days] to 93.

Section 111.4 [Amount] to Not less than $100.00 per day, [Amount] to Not more than $500.00 per day.

Sec. 42-183. Amendments.

Whenever the following words or phrases are used in the Fire Prevention Code adopted by this article, they shall have the same meanings respectively ascribed to them by this section:

Chief of the bureau of fire prevention and bureau of fire prevention mean the Chief of the Fire Department and the Fire Inspector.

Corporation Counsel means the City Attorney.

Municipality means the City of Trenton, Michigan.

Delete sections 102, 103, 104, 105, 109, 112.1, 202, 302, 307, 508.5, 508.4.1, 610, 901.6.2, 903.2.10.3, 904.3.5, 907.2.12 907.4.4 907.7.1, 907.9.2 907.10.2.1, 907.12.1, 1005, 1201, 2201, 2206, 2803, 3301, 3308, 3401, 3405, 3801, Appendix D. Change Chapter 45 to Chapter 80.

Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.

Section 5. That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the date of its final passage and adoption.

Section 6. Saving Clause. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

Section 7. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such work, sentence, phrase or any portion of the Ordinance held to be so invalid shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance.

Section 8. Conflicting Ordinances. All prior existing ordinances adopted by the City of Trenton inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed.

Section 9. Readings. This Ordinance shall be given a first reading on June 5, 2017, shall be enacted on June 19, 2017 and shall be published on or before June 26, 2017 and shall be effective June 27, 2017.

ADOPTED, APPROVED AND PASSED by the City Council of the City of Trenton this 19th day of June, 2017.
